Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and Valkyrja Labs (“Valkyrja Labs”, “we”, “us” or “our”) governing your use of Skald, including our mobile application, our web application and skaldapp.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 16 years old to use the Service. You may create only one account, and you are responsible for keeping your sign-in details secure and for all activity that occurs under your account. Please notify us promptly at support@skaldapp.com if you believe your account has been compromised.
2. Your Contributions
“Contributions” means any text or other material you submit through the Service, including lines, stories and Scrolls you start or write.
Ownership
Because every story in Skald is written collaboratively by many players, Valkyrja Labs owns the stories created on the Service. By submitting a Contribution, you assign to Valkyrja Labs all right, title and interest, including all copyright and other intellectual property rights, in that Contribution throughout the world, for the full term of those rights, without further payment to you.
Licence where assignment is not permitted
If the law where you live does not permit such an assignment, you instead grant Valkyrja Labs an exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, modify, adapt, translate, publish, distribute, publicly display and perform your Contributions, and to create derivative works from them, in any media now known or later developed, including for the purpose of promoting the Service.
Your continuing rights
You may keep and share copies of your own Contributions for personal, non-commercial purposes. Other players who contributed to the same Scroll may read and keep the completed story.
Your promises
You confirm that each Contribution is your original work, that you have the right to assign it as described above, and that it does not infringe anyone else’s rights. To the extent permitted by law, you waive any moral rights in your Contributions. These rights continue after you stop using the Service or delete your account.
3. Acceptable Use
You agree not to submit content or use the Service in a way that:
- is unlawful, defamatory, harassing, hateful or threatening;
- is sexually explicit, or sexualises minors in any way;
- infringes the intellectual property or privacy rights of others, or shares anyone’s personal information;
- contains spam, advertising or malicious code; or
- involves cheating, automated play, exploiting bugs or interfering with the Service.
We may remove any content and suspend or terminate any account that we believe violates these Terms. Players can report content using the Report feature in the app.
4. Virtual Items and Purchases
The Service may include virtual items such as Coins, Raven Obols and collectibles. Virtual items are licensed to you, not sold. They have no monetary value, cannot be exchanged for real money, and cannot be transferred outside the Service. Except where required by law or by the policies of the store through which you purchased them, all purchases are final and non-refundable.
Bard is a recurring subscription that renews automatically until cancelled. You can cancel at any time through Google Play or, for web purchases, through the billing portal. Cancellation takes effect at the end of the current billing period. We may change prices with notice.
5. Advertising
The Service offers optional rewarded advertisements. Rewards are granted only for advertisements watched to completion, and we may limit the number of rewarded advertisements available.
6. Our Intellectual Property
The Service, including its software, artwork, sounds, names and logos, is owned by Valkyrja Labs and its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for your own entertainment, subject to these Terms.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections 2, 6, 8, 9 and 10 survive termination.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free or always available.
9. Limitation of Liability
To the fullest extent permitted by law, Valkyrja Labs will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits any rights you have under applicable consumer protection law.
10. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. If you live in the European Union or the United Kingdom, you also benefit from any mandatory protections of the law of your country of residence.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
